League Comments on NJDEP/3M Settlement

As recently reported by the League, on July 21, the New Jersey Department of Environmental Protection (DEP) published a Notice to Receive Interested Party Comments on the JCO approving a settlement with 3M Company (3M). The settlement releases 3M from liability stemming from its sale, marketing, distribution, use, or manufacture of PFAS in New Jersey. It also precludes existing and future claims by the state’s political subdivisions.  

Comments to extend the 60-day comment period for the 3M Notice of Proposed JCO were declined by the DEP and the public comment period closed on September 19. The League submitted comments in response to the Notice as well as several of its members, experts, and other interested parties.   

Please read the League’s previous blog post with additional information on this settlement, as well as the settlement with DuPont arising out of the same incident. The 60-day public comment period for the DuPont settlement commenced on September 2. The U.S. District Court’s scheduling order has directed DEP to file its motion to approve both settlements by November 21, 2025.
