This week, Governor Phil Murphy signed S-428 into law, amending the Right to Farm Act to specify that shellfish aquaculture activities are eligible for Right to Farm Act protections.
To be eligible for Right to Farm protections a shellfish commercial farm must produce shellfish worth $40,000 or more annually. The shellfish commercial farm would not have to qualify for farmland assessment for the protections to apply. P.L. 2023, c. 20 became effective on March 13.
