I. League Urges Governor to Fully Fund Clean Communities and Recycling Programs
Yesterday, the League of Municipalities wrote to Governor Murphy objecting to the proposed diversion of Clean Communities and Recycling Grant funding included in the Administration’s proposed FY 2021 budget. The State is looking to use the reallocated funding to support State Parks.
We had already contacted the Senate and Assembly budget writing committees objecting to the proposed diversions of $12 million from the State Recycling Trust Fund and $10 million from the Clean Communities Trust Fund. In the State’s last Fiscal Year, the Recycling Trust Fund provided $14.3 million in grants to municipalities to support their recycling efforts. Also last Fiscal Year, the Clean Communities Trust Fund provided $17.3 million in grants to support municipal anti-litter programs, beach clean-ups, stream clean-ups, and other local environmental activities.
When these programs were put in place, the League was successful in the inclusion of "poison pill” provisions, designed to discourage future raids on the funding. Specifically, if the annual appropriations act does not fully fund the Clean Communities and the Recycling Grant accounts, the Director of the State’s Division of Budget and Accounting is required to notify the Director of the Division of Taxation of that failure. The statutory provisions authorizing the taxes and fees that fund both programs would then “be without effect.” In other words, this would not only create immediate gaps in local budgets, but also a significant hole in State revenues, going forward.
We have asked the Governor, to please let us know he plans to correct this issue, prior to enactment of the FY 2021 Appropriations Act.
