NJBPU Proposes Rule Amendments Applicable to Municipalities

On August 21, New Jersey Board of Public Utilities (NJBPU) published proposed rule amendments governing all utilities, including municipal water and wastewater utilities. These changes include:  

  1. The extension of the Winter Termination Program to water and wastewater residential customers, pursuant to P.L. 2021, c. 317
  2. Changes made to comply with legislation, which requires public utilities and municipalities to give each other notice of infrastructure projects and coordinate schedules, pursuant to P.L. 2021, c. 263; and 
  3. Add a requirement that water, and wastewater utilities use the same methodology as gas and electric utilities to are required to use to “gross up” for taxes the deposits and non-refundable contributions collected for extensions to provide for regulated services, if the deposits or nonrefundable contributions become taxable in the future.   

Comments regarding these proposed amendments are due October 20.
