The New Jersey Supreme Court has issued an Order withdrawing Guideline 4 which was the subject of a recent memorandum issued by the Acting Director of the Administrative Office of the Courts (AOC).
The recent AOC memorandum, sent to assignment judges and municipal court presiding judges, states that Guideline 4, which prohibits all plea agreements whatsoever in drunken driving or certain drug offenses, remains in effect. The memorandum came after a new law signed last year meant to allow the use of plea bargaining in minor DUI cases.
With today’s Order, the AOC’s memorandum is no longer applicable.
Municipal judges, prosecutors, and court staff should be aware of the Court’s Order.
