[ARCHIVED] Senate Committee Advances Short Term Reseller Legislation

On Thursday, the Senate Community and Urban Affairs Committee favorably reported an amended version of S-2850. The League had opposed this legislation, but the amended version addressed our concerns. We want to thank Senators Oroho and Greenstein for hearing our concerns. 

As introduced, the legislation establishes certain requirements if purchasing and reselling the same single-family home within one year of receiving a certificate of occupancy. Among the requirements included in the bill was that there was an inspection of the single-family home purchased from a short-term reseller prior to the conclusion of the closing process to help ensure the requirements of the Uniform Construction Code (UCC) were followed. The League’s opposition was based on the concern of municipal enforceability of these requirements not being attainable at this time. In order to accomplish the goals of S-2850 municipalities must be able to hire inspectors.  However, given the current economic climate municipalities are facing the same challenges as the private sector in finding qualified individuals to hire. 

Since the section regarding municipal inspections was deleted, the League no longer opposes this legislation.
